1.3 Key Terms Used in These Rules:- “Hotel” — a property complex (building, part of a building, equipment, and other assets) intended for providing hotel services, including the "BERGS SPA & Detox," located at 354002, Krasnodar Krai, Sochi, Uchitelskaya Street, Building 15.
- “BERGS SPA & Detox” Complex (hereinafter referred to as the “SPA complex”) — a structural subdivision of the Hotel, located on its premises, offering a variety of SPA services and aimed at serving the Hotel’s Guests and Visitors.
- “Guest” — an individual residing in the Hotel who intends to order or purchase, or is ordering, purchasing, and/or using the SPA complex’s services exclusively for personal or other purposes not related to entrepreneurial activities.
- “Visitor” — an individual not residing in the Hotel who intends to order or purchase, or is ordering, purchasing, and/or using the SPA complex’s services exclusively for personal or other purposes not related to entrepreneurial activities.
- “SPA Service” — SPA procedures and services of a general wellness, cosmetic, relaxing, or physical wellness nature provided in a highly comfortable environment.
- “SPA Procedure” — a set of actions related to one or more SPA technologies aimed at achieving a planned result.
2. SPA Complex: Operating Hours and Rules for Providing SPA Services
2.1 Guest or Visitor service in the SPA complex is provided upon signing a questionnaire, which serves as a binding agreement.2.2 The SPA complex operates according to its schedule from 9:00 AM to 9:00 PM.2.3 The SPA complex includes:- Turkish hammam
- Indoor heated pool
- Russian banya
- Massage rooms
- Fitness hall with equipment (rowing machine and elliptical trainer)
- Terraces with panoramic views of the sea, city, and mountains
2.4 For the safety of the facility, guests, and material assets, and to ensure compliance with mandatory procedures and measures for anti-terrorism protection, a video surveillance system is in operation in the Hotel and on the premises of the SPA complex.2.5 Payment for SPA services can be made in cash, via bank card, or through SBP.2.6 Guests (Visitors) are required to pay for the provided SPA services in full.2.7 Minors under the age of 14 are allowed in the SPA complex only when accompanied by a parent, legal guardian, or another adult (hereinafter referred to as the "accompanying person"). The accompanying person assumes full responsibility for the child during their visit to the SPA complex, including the child's health, safety, appropriate behavior, and compliance with the Rules. Upon request by the administration, the accompanying person must confirm this by presenting identification documents and signing a waiver acknowledging the Rules and accepting the risks associated with visiting the SPA complex.2.8 Minors aged 14 to 18 are allowed to visit the SPA complex independently, provided they comply with all the requirements outlined in these Rules for adult visitors. Teenagers must carefully review the Rules, understand all associated risks, discuss these risks and the possibility of visiting the SPA complex with their parents (legal guardians), and obtain their consent. The administration has the right to request a passport or other identification document, as well as a signed waiver confirming familiarity with the Rules, agreement from the legal guardians, and acceptance of the risks associated with visiting the SPA complex.2.9 The SPA complex reserves the right to refuse admission without explanation. Grounds for such a decision may include any display of aggression or inappropriate behavior, such as:- Being under the influence of drugs, toxic substances, or alcohol, visibly determined by SPA staff and causing discomfort to other guests of the SPA complex;
- Engaging in unlawful acts against other Guests and Visitors, staff, or property of the SPA complex;
- The use or distribution of narcotics; possession of weapons or sharp objects;
- Violating these Rules.
2.10 Guests and Visitors' belongings are stored in the lockers located in the changing area, equipped with electronic locks. Guests are advised not to leave valuables in the lockers or leave personal belongings unattended.2.11 While on the premises of the SPA complex, Guests and Visitors may be featured in photographs, videos, television or radio broadcasts, or press publications.2.12 Starting from June 1, 2014, in accordance with Article 12 of Federal Law No. 15-FZ dated February 23, 2013, "On Protecting the Health of Citizens from the Effects of Tobacco Smoke and the Consequences of Tobacco Use," smoking is strictly PROHIBITED within the SPA complex. Violation of this prohibition results in administrative liability under Article 6.24 of the Code of Administrative Offenses of the Russian Federation. According to Part 1, offenders are subject to an administrative fine of 10,000 (ten thousand) rubles. Smoking is only allowed in designated smoking areas.2.13 Information regarding the requirements and recommendations for visiting the SPA complex and using its facilities is provided in these Rules and on signs and informational boards located within the SPA complex premises. For clarification about these requirements, Guests and Visitors may contact the SPA complex staff.3. Rules for booking SPA and it's Services
3.1 A Guest and/or Visitor can book SPA services from the SPA menu by contacting the reception desk or by phone: +7 918 40 40 300 ext. 3000.3.2 When making a reservation, the Guest and/or Visitor has the right to choose a specialist (from those available on the day the SPA service is to be provided). Preferences should be indicated to the administrator at the time of booking.3.3 The day before the visit, the administrators will make reminder calls or send text reminders to Guests and/or Visitors to confirm the booking.3.4 It is recommended to arrive 5-10 minutes before the scheduled start time of the procedure to allow time for changing. Robes, slippers, towels, and disposable underwear will be provided. When booking access to the hammam, pool, or terraces, robes, slippers, and towels are available for an additional fee.3.5 If a Guest and/or Visitor is delayed for more than 20 minutes, the SPA administrator has the right to cancel the appointment in favor of the next waiting Guest (Visitor).3.6 When booking a SPA service, the Guest and/or Visitor will be informed that any delay may affect the duration of the SPA procedure, as changes to the schedule may negatively impact other clients of the complex.3.7 Before the SPA procedure or SPA complex visit, the Guest and/or Visitor must fill out a Guest Questionnaire and inform the administrator and specialist of any known contraindications or chronic illnesses, so the specialist can conduct the SPA procedure appropriately or, if necessary, replace it with another service.3.8 It is recommended to remove jewelry and watches. The Hotel is not responsible for items left in robe pockets, on procedure room tables, or in public areas.
4. Rights and Responsibilities of Guests and Visitors of the SPA Complex
4.1 Guests and Visitors of the SPA complex are required to:
- Familiarize themselves with and adhere to these Rules;
- Follow public order rules, behave respectfully towards other visitors, SPA staff, and refrain from actions that may endanger the health and safety of others;
- Comply with the SPA complex’s visiting rules, safety protocols, fire safety regulations, hygiene standards, and the staff’s instructions;
- Inform the SPA staff of any dangerous situations or objects that could pose a threat to the safety of people in the SPA complex;
- Return used towels when leaving the SPA complex;
- Adhere to the schedule of sessions and the overall time spent in the SPA complex;
- After a session, Guests and Visitors are obliged to vacate their locker in the SPA complex changing room;
- Guests and Visitors must maintain cleanliness in all SPA facilities used before, during, and after the sessions;
- Guests and Visitors must treat SPA complex property with care, avoiding damage or loss;
- Guests and Visitors must comply with all instructions given by SPA staff related to safety and behavioral rules.
4.2 Guests and Visitors of the SPA complex have the right to:
- Receive SPA services in full and of proper quality;
- Pay for the services rendered by any means specified in these Rules;
- Visit the SPA complex with children in accordance with these Rules.
4.3 Guests and Visitors of the SPA complex are prohibited from:
- Disrupting public order or disturbing the peace of other Guests and Visitors;
- Making noise, shouting, or using offensive language;
- Entering specialists' rooms and staff areas without permission from the SPA staff;
- Wearing outer clothing, uniforms, or large items, except for uniforms of law enforcement officers, military personnel, or government officials, and dirty or torn clothing and shoes that may soil the interior or other guests;
- Bringing into the SPA complex:
- Animals;
- Bicycles or other vehicles, except for strollers and wheelchairs;
- Flammable, explosive, toxic, poisonous substances, including household gas cylinders;
- Firearms, sharp or cutting objects, or other means of self-defense (gas canisters, stun guns, etc.);
- Alcoholic and non-alcoholic beverages or food;
- Glass items or other fragile objects that could shatter and create dangerous fragments;
- Inflatable rings, mattresses, or other swimming equipment, except for children's swimming gear;
- Being in the SPA complex while under the influence of alcohol, drugs, or toxins, or carrying, consuming, or distributing drugs or psychotropic substances;
- Using payment cards belonging to others;
- Bringing and using any pyrotechnics (including fireworks, sparklers, candles, incense sticks, etc.);
- At the pool: jumping, diving, or entering the water in other ways from the pool edges, as the pool’s dimensions are not designed for such actions and may cause injury; walking on the grates covering the pool’s overflow channels; engaging in excessive activity, including allowing children to be overly active, or performing actions that may pose a danger to others;
- Playing cards or other gambling games for money, items, or valuables;
- Engaging in actions that simulate behavior not appropriate for children or actions contrary to socially accepted behavior and moral norms;
- Visiting the SPA complex with:
- Open wounds with bandages, plasters, or dressings;
- Fever, conjunctivitis, infectious diseases, or other illnesses that may pose a risk to the SPA’s sanitary and epidemiological conditions or the health of other Guests and Visitors;
- Significant mental disorders or inadequate reactions.
4.4 Guests and Visitors should refrain from visiting the SPA complex if:
- Pregnant women with any complications or specific pregnancy conditions;
- Infants;
- Individuals with pacemakers or heart diseases, unstable blood pressure;
- Individuals with heightened skin sensitivity to chlorinated water.
5. Rules for Guests and Visitors Visiting the Hammam and Russian Banya at the SPA Leisure area:
5.1 Visiting the hammam or Russian banya is permitted only for individuals whose physical and mental condition allows them to safely endure exposure to high and low temperatures and rapid temperature changes without harm to their health or emotional well-being.
5.2 The hammam and banya are not suitable for individuals with heart, vascular, or blood pressure issues, other medical contraindications, sensitivity to environmental temperature changes, pregnant women, and children.
5.3 Contraindications for visiting the hammam or banya include acute infectious and other illnesses, fever, severe atherosclerosis affecting various organs and systems, active tuberculosis, infectious skin diseases, malignant tumors, a tendency to bleeding, thrombosis, embolism, and severe metabolic disorders such as diabetes mellitus, among others.
5.4 Before visiting the hammam or banya, Guests or Visitors are required to take a shower.
5.5 The visit to the hammam or banya is entirely under the control of the Guest or Visitor. Prolonged exposure in the hammam or banya can cause elevated body temperature, dehydration, blood thickening, and impaired blood flow, which may pose a health risk.
5.6 The following activities are prohibited in the hammam and Russian banya:
- Pouring, spraying, or using water, aerosols, or other substances on the stoves.
- Wearing jewelry while visiting.
- Using mobile phones or other electronic devices.
- Adjusting the temperature or operating any equipment independently.
- Touching heating elements, pipes, stones, or other steam and heating components.
- Approaching the steam outlet area from the sides of the steam delivery bowl or leaning on steam exit points.
- Crossing established barriers.
- Using personal creams, ointments, oils, or other skin products, as well as birch whisks or other sauna accessories brought from home.
- Covering the stove with foreign objects, drying towels, shaving, washing, or drying clothes, or engaging in activities other than steaming.
- Allowing children under 14 years old to visit the hammam or banya without adult supervision.
- Leaving minors unattended.
- Being under the influence of alcohol, drugs, or other substances that impair reaction time.
5.7 While using the hammam or banya, Guests or Visitors are required to strictly adhere to the Rules and the instructions of SPA staff, including:
- Removing footwear before entering and covering their head with a towel to prevent overheating.
- Using a personal towel to avoid direct contact between the skin and benches or other surfaces (laying a towel on the seat to comply with personal hygiene requirements).
- Limiting the first session to 5–10 minutes, depending on the individual’s condition, followed by a break of at least 20 minutes. The second and third sessions are permitted only if the individual feels well and should not exceed 10–15 minutes each.
- Leaving the hammam or banya immediately if feeling unwell or experiencing discomfort.
- Taking a shower after visiting the hammam or banya and before entering the pool water.
6. Rules for Visiting the Fitness Hall
6.1 The fitness hall operates according to the schedule of the SPA complex. However, the general operating hours of the SPA complex and the schedules of specific zones (pool, hammam, terrace, massage rooms, sauna, etc.) may vary.
6.2 The cost of a single visit to the fitness hall:
- Guests staying in rooms of the categories Suite, Junior Suite, and Deluxe with a balcony can access the fitness hall at no additional charge (included in the room price).
- For other hotel guests and visitors, the fees are determined by the rates set by the SPA complex.
- For all categories of guests (visitors), group and/or individual training sessions with a trainer incur an additional fee according to the rates established by the SPA complex.
6.3 Guests exercise independently in the fitness hall.
6.4 When visiting the fitness hall, it is necessary to change into sportswear and footwear that allow free movement. Exercising in robes and slippers is not permitted.
6.5 During the workout, guests are advised to monitor their well-being and choose exercises suitable for their fitness level.
6.6 The SPA complex is not responsible for guests' health conditions or potential injuries if they exercise without consulting a trainer.
6.7 If guests feel unwell during training, they must stop the workout immediately.
6.8 It is prohibited to:
- Use equipment brought in from outside without special permission from the staff.
- Perform exercises near mirrors, glass-paneled doors, equipment, or inventory.
- Move fitness machines and other equipment without staff permission.
- Engage in workouts with unhealed injuries or when feeling unwell.
7. Rules for visiting the Terrace.
7.1 The terrace is open from 9:00 AM to 9:00 PM – daily.
7.2 While on the terrace, it is necessary to observe public order rules.
7.3 CLIMBING OVER THE BARRIERS AROUND THE ROOFTOP IS PROHIBITED. The SPA complex administration reserves the right to impose a fine on Guests (Visitors).
7.4 Being on the terrace with a bare torso or in a swimsuit is allowed. Topless sunbathing is prohibited.
7.5 The consumption of alcoholic beverages brought from outside is prohibited throughout the SPA complex and on the terrace.
7.6 During the stay on the SPA complex premises, no more than two light alcoholic beverages, ordered from the SPA complex bar, may be consumed.
7.7 The consumption of bar products is allowed on the terrace.
7.8 It is recommended to wear headwear and maintain proper hydration.
7.9 It is STRICTLY PROHIBITED for children to be on the terrace without adult supervision.
8. Rules for Pool Use
8.1 Guests (Visitors) are allowed to use the pool only during working hours from 09:00 to 21:00.
8.2 Enter the pool only by the special ladder, facing the water!
8.3 Swimming in the pool is allowed only in swimwear: trunks, swim shorts, swimsuits (for women), swimwear for children of any age. Children under 1.5 years old may use the pool only in special swim diapers.
8.4 Drinking alcoholic beverages, smoking, creating conflict situations, using obscene language, making offensive remarks or engaging in hooligan behavior towards others (Article 20.1 of the Administrative Code of the Russian Federation); (Article 20.20 of the Administrative Code of the Russian Federation); (Article 20.21 of the Administrative Code of the Russian Federation); The administration reserves the right to refuse guests entry to the pool without explanation.
8.5 The administration of the SPA complex is not responsible for the loss/damage/destruction of property left unattended by guests.
8.6 Guests must adhere to the general and personal hygiene rules, including keeping their body clean and taking a shower before using the pool in the SPA complex's shower areas.
8.7 The water temperature in the pool is maintained within the sanitary and epidemiological norms and cannot be changed upon guest request.
8.8 Specific rules for pool use by minors (children):
- Only individuals over 14 years old who can swim without additional devices are allowed in the swimming pool;
- Children under 14, as well as older children who cannot swim, are not allowed without adult supervision;
- Parents must continuously monitor the behavior of minors in the pool area;
- Parents are solely responsible for the safety and well-being of minors in the pool area.
- 8.9 The following individuals are advised against using the pool:
- Individuals who cannot swim and stay in the pool without additional devices (responsibility for non-compliance lies with the guest);
- Pregnant women in advanced stages of pregnancy;
- Individuals with infants, individuals with pacemakers, and heart conditions;
- Individuals with heightened sensitivity to thermal water or sunlight;
- Individuals with health conditions that may worsen from sun exposure and/or prolonged time in water.
- 8.10 For safety reasons, the following actions are prohibited in the pool:
- Running around the pool, jumping, pushing, creating excessive noise, giving false distress signals, throwing objects, spitting, or pouring liquids into the pool water.
- Diving and holding breath underwater.
- Creating obstacles for other guests and staff in the water.
- Entering the water with chewing gum, or relieving natural bodily needs in the pool water.
- Jumping from the pool edge, playing in the water, or doing anything that may endanger the safety and health of the guest, other guests, and staff.
- Visiting the pool without swimwear, washing fruits, vegetables, or other items in the pool.
- Visiting the pool with open wounds, other skin damage, bandages, or casts.
- Visiting the pool with clear signs of health disorders, individuals displaying inappropriate behavior, or individuals intoxicated by alcohol or drugs.
- Bringing the following to the pool area:
- Animals, birds, reptiles, and insects;
- All kinds of weapons, explosives, flammable, toxic, radioactive substances, individual protection means (gas canisters, stun guns, etc.);
- Audio equipment and other sources of loud noise;
- Sharp objects, glass items, and other fragile items that may break into shards;
- Alcohol and drugs;
- Medicines and pharmaceuticals.
- The ADMINISTRATION reserves the right to independently limit a guest's stay in the pool or refuse to provide services without explanation.
- The ADMINISTRATION is not responsible for injuries or damage resulting from the violation of safety rules.
- The ADMINISTRATION is not responsible for children left unsupervised by parents. The ADMINISTRATION is not responsible if other guests occupy your lounger.
- The ADMINISTRATION is not responsible for the safety of personal belongings, money, and valuables left unattended.
9. Responsibility of Guests and Visitors of the SPA Complex for Violating These Rules
9.1 In the case of violation of these Rules, the SPA complex staff has the right to:
- Record video and audio of the violations;
- Remove the violator from the SPA complex premises;
- If necessary, detain the violator and call law enforcement authorities, as well as file a report for bringing the Guest and/or Visitor to responsibility;
- Impose a ban on further visits to the SPA complex for the Guest (Visitor) violator;
- If the Guest (Visitor) causes damage to the SPA complex property, recover the full market value of the damage from the perpetrator.
